Can my landlord issue me a fine for having parties?

There is a provision in my lease that states that there shall be no parties (defined by more than 10 people and a presence of alcohol) in the house that I lease. I live in a college town (University of Maryland College Park), and have violated this term of the lease. Is it legal for him to be charging me $1000 fines even though it is in the lease? He charged me $500 after a neighbor complained of noise coming from my house. What is the proper procedure for these actions? Is this legal? To clarify, it is in the lease that we are not allowed to have parties, and that the fine is $1000. The fact that he can issue a fine without visiting the premisis, or having a police complaint seems suspect to me. Our neighbor happens to be a city council member and when she complained of noise we were fined $500.

Call the housing authority. If you signed a lease that he can fine you, then he may be in the right. But assessing arbitrary fines doesn't sound kosher without showing documented damages.

If the fine is spelled out in the lease then it is legal. If it is not, then it is not. Usually a violation of the terms of a lease is grounds for termination of the lease. If you were smart you would have had only 9 people over if alcohol is present. If there was no alcohol present, then presumably you could have had 100 people over, because the lease defines a party as more than 10 people AND the presence of alcohol, so BOTH conditions would have had to be present for there to be a violation of the "no party" clause of the lease..

this is not legal at all, he can't put "no parties" in the lease. your free to do as you please as long as it's lawful and does not violate city by-laws and if it did it would be by-law officers or police that could issue fines. you don't have to pay it, it's just a cash grab. your landlord sounds like an asshole

Cannot say for certain but this does sound highly illegal to me. He definitely has the right to serve you notice to leave and wouldn't be surprised if you had one of these, especially as you were advised (and fined) of a previous incident. I would suggest seek legal advice, and possibly move somewhere where you can have parties without annoying others.

if its not in the terms he cant legally do it, will you get kicked out if you dont pay, more than likely. then you might have a case and can take legal action but its prolly not even worth it Heres your options tell him to suck it, dont pay, and find a new place pay up, keep your mouth shut, dont party

If it states on your lease that it is against the rules AND you will be fined, then he can charge you. If the lease says nothing about a fine (or even neglects to state the exact amount of the fine) then you may have a case against him to lift or at least reduce the fine.

If its in the lease and you signed it, sounds legal to me. We fine our tenants $100 if they disconnect the smoke detectors or discharge a fire extinguisher without cause. We also have a clause that if the police come for a noise complaint, we can evict with a three day notice without the right to appeal in court. It's not clear whether the amount of the fine is specified in the lease. If it's not, then he can't make up an amount to fine you, but he may be able to evict you and hold you liable for the term of the lease. PS, the neighbor gets 20% from the landlord to complain..

You agreed to such in the lease...and now your questioning what you signed??? The proper procedure is to charge the fine...and then evict you for lease violations.

You were disrupting your neighbors. That is illegal. Most landlords would have called the police on you and had you evicted. If you dont like the fees then move out. You should have never signed a lease that says 'no parties' if you had planned on having them.
