independent contractor agreement
How can i avoid or circumvent The no sublet clause in my rental agreement?
Question
How can i avoid or circumvent The no sublet clause in my rental agreement?
I live in a rent- stabalized month 2 month léase apartment. I'd like 2 have someone stay in it while I'm out Of town for The NeXT 10 months. However my landlord doesn't allow sublets. If i have an extended "house guest" - wink wink- who gives me cash on the side can i still be evicted or get into trouble? Is there a way to avoid or circumvent The no sublet clause in my rental agreement? Plus The apt léase also stipulates i can't live with anyone in my studio. Still if I have several "guests" or "friends" staying there throughout the Time I'm away might there be someway to make ot work? I'm going 2 be starting a new profession which would make me an independent contractor & I won't have The payroll salary which comes with a traditional Job. So giving up The apt could potentially leave me in a vulnerable position in getting a new rental apt.! I expect i will have money, substantial savings ( maybe equivalent 2 a years rent) and good crédit score however at this moment I'm not sure about having a guarantor in place. Of course another part Of me says give up The Albatross and move on. I mean in this climatérica there had 2 be a landlord who would take cash & take into consideration my business earnings right? Yes I'm projecting earnings. Still i mean if I did just stop The place there must be The possibility for a sublet or extended hotel or home rental option where people aré flexible, right? So can i possibly get past The rental clause if I play with thevwords & use the term guest or house sitter in an agreement? Or should I just drop it all & roll the dice, see what happens down the line. Also my landlords sniffing around the place. He noticed some stuff I put in storage & has already asked if I'm living in the apt. I can't afford 2 keep 2 places. The rent stabalization thing isn't a primary factor with me. If the rent went up so what. My primary reason for considering trying 2 keep the apt is whether I'll easily qualify 4 a new one in a year. Also I don't have addtl income now but I expect 2 have enough to support myself later.

Sit down with your landlord and renegotiate. He/she might be happier with a 10 month tenant that they approve of than with you vacating the apartment.

Move out. You are going to jerk this guys chain and piss him off. Besides, if you are leaving for 10 months...Find a new place when you get back. He owns the bldg, not you, he rents it out, not you.

What a mess! You must live in the People's Republic of Santa Monica or New York City. I've heard of people who somehow manage to hang on to their rent controlled units for years and years and years - even after buying a home in another state. Good luck. Ask around. I am sure there are others in your circle of acquaintances who are successfully doing what you want to do.

you are asking how to break the law and/or intentionally violate your lease. it isn't worth the potential hassle ... landlord sues you in court, etc. while you're away. [he has the right to notify you by posting on the apartment door since you "live there" -- if the notice is ineffective, you don't live there and his case is proved.] so you have to either hire an attorney to show up in court for you [at your expense] or you have to come back to the city to appear. either way costs you cash out of pocket for a case that you'll likely lose. move on

It is not legal to sublet a rent subsided unit, the tax payers are paying part of your rent. A house guest can not remain in the unit more then 14 days in a year. I also doubt you will still qualify to live off of the government with your new income. You need to start there, that alone may very well mean that you have to move out.
